Privacy Policy
Effective November 1, 2026
This Privacy Policy describes how Ultra Realty Group LLC, doing business as Land & Sea International Realty (“Land & Sea,” “we,” “us” or “our”), collects, uses, discloses and protects information through landandsearealty.com and any page, form, search tool, listing feed or communication that links to this policy (together, the “Site”). By using the Site or submitting information through it, you acknowledge that you have read this policy and agree that your information will be handled as it describes. If you do not agree, please do not use the Site or submit information to us.
Information We Collect
Information you give us
- Contact and inquiry forms: your name, email address, telephone number and the content of your message.
- Home value and seller requests: your name, email address, telephone number, the property address, your selling timeframe and whether you are working with an agent.
- Property searches and saved searches: if you register or save a search, your email address, contact details, search criteria, saved properties and alert preferences.
- Correspondence: anything you send us by email, telephone, text message or in person, including information about the property you want to buy or sell.
Please do not send us Social Security numbers, bank or card numbers, account passwords or similar sensitive information through the Site or by unencrypted email. We do not request that information through the Site, and transaction documents that require it are handled through secure channels outside the Site.
Information collected automatically
When you visit the Site, we and our service providers automatically collect technical information such as your IP address, browser and device type, operating system, referring page, pages viewed, links clicked, time spent on pages, the date and time of your visit and an approximate location derived from your IP address. We collect this through cookies, pixels, local storage and similar technologies, described under “Cookies and Analytics.”
Information from other sources
Property listings, listing photographs and market data on the Site come from the multiple listing service of the Naples Area Board of Realtors® through an Internet Data Exchange (IDX) feed, and from public records. We may also receive information about you from people who refer you to us, from cooperating brokers and from public sources, and combine it with information we already hold.
How We Use Information
- To respond to your inquiries and provide real estate brokerage services you request, including showing, listing, valuing, buying and selling property.
- To send listing alerts, market reports and other communications you have asked for or that relate to your inquiry.
- To operate, maintain, secure and improve the Site, understand how it is used, and develop new content and features.
- To detect, prevent and respond to fraud, spam, abuse, security incidents and other harmful activity.
- To comply with law, regulation, licensing and MLS rules, record-keeping obligations and lawful requests, and to establish, exercise or defend legal claims.
- For any other purpose disclosed to you when the information is collected, or with your consent.
We may create de-identified or aggregated information that cannot reasonably be used to identify you, and use it for any lawful purpose.
How We Share Information
We do not sell your personal information, and we do not share it with third parties for their own marketing. We disclose information only as follows:
- Our agents and offices: with licensed agents and staff of Land & Sea, including our Marco Island office, so they can respond to you.
- Service providers: with companies that perform services for us under obligations of confidentiality, such as website hosting and security, content delivery, email, form processing, property search and saved-search tools, analytics and font delivery. They may use the information only to provide those services.
- Transaction parties, at your direction: when you ask us to help with a purchase, sale or lease, with cooperating brokers, sellers or buyers, lenders, title and closing agents, attorneys, inspectors, appraisers, insurers and similar parties as needed to carry out the transaction.
- Legal and safety: when we believe in good faith that disclosure is required or permitted by law, subpoena, court order or other legal process; to comply with licensing, MLS or regulatory requirements; or to protect the rights, property or safety of Land & Sea, our clients, agents, users or the public.
- Business transfers: in connection with a merger, acquisition, financing, reorganization or sale of all or part of our business, subject to this policy.
- With your consent: for any other purpose you authorize.
Calls, Texts and Emails
If you give us your telephone number or email address, you agree that we may contact you by telephone call, text message or email about your inquiry and the property services you requested. We will send recurring marketing text messages or place marketing calls using automated technology only with your separate, express written consent, which is never a condition of buying or selling property or of using the Site. Message frequency varies, and message and data rates may apply. You may opt out of text messages at any time by replying STOP, and out of marketing email by using the unsubscribe link in any message or by writing to us. We may still send messages that relate to a transaction in progress or that are required by law.
Cookies and Analytics
The Site uses cookies and similar technologies that are necessary for it to work and stay secure, that remember preferences in property searches, and that measure how visitors use the Site. Our analytics providers currently include Google Analytics and Ahrefs Web Analytics, and our property search provider uses its own analytics. Fonts are delivered by Adobe Fonts, and security screening by Cloudflare, each of which receives your IP address and browser information in delivering its service. Embedded videos and maps are served by their providers and are subject to those providers’ terms and policies.
You can block or delete cookies through your browser settings, and you can prevent Google Analytics from using your data by installing Google’s Analytics Opt-out Browser Add-on. Blocking cookies may cause parts of the Site, such as saved searches, to stop working. Because there is no common industry standard for “Do Not Track” signals, the Site does not respond to them. Because we do not sell personal information or share it for cross-context behavioral advertising, a Global Privacy Control signal requires no further action from us; we treat it as confirmation of that choice.
Data Retention
We keep personal information for as long as needed to provide the services you requested, to maintain our business and transaction records, and to meet legal, licensing, tax, accounting and dispute-resolution requirements. Florida law requires real estate brokers to keep transaction records for a minimum period, and records relating to a transaction may be kept for that period or longer. When information is no longer needed, we delete or de-identify it.
Security
We use reasonable administrative, technical and physical safeguards designed to protect personal information, including encrypted connections to the Site. No website, transmission over the internet or method of storage is completely secure, however, and we cannot guarantee the security of information you send to us. You transmit information at your own risk, and you are responsible for keeping your passwords and devices secure. If we learn of a security breach affecting your personal information, we will notify you and the authorities where and as required by applicable law, including Section 501.171 of the Florida Statutes.
Your Choices and Rights
You may ask us to tell you what personal information we hold about you, to correct it, or to delete it, and you may withdraw consent you have given or opt out of marketing communications at any time. Send requests to the contact details below. We will need to verify your identity before acting on a request, and we may decline or limit a request where the law permits, for example where we must keep information to complete a transaction, comply with a legal obligation, resolve a dispute, prevent fraud or enforce our agreements. Residents of states whose privacy laws apply to us have the rights those laws provide, and we will respond to verified requests within the time those laws require. We will not discriminate against you for exercising your rights.
Children
The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided personal information to us, contact us and we will delete it.
Links and Third-Party Services
The Site contains links to, and content from, websites and services we do not control, including other brokerages’ listings, mapping and video services, social media and our affiliated Marco Island and St. Simons Island websites, each of which has its own policies. This Privacy Policy does not apply to them, and we are not responsible for their content or privacy practices. Your use of them is at your own risk and subject to their terms.
Users Outside the United States
The Site is operated in the United States and is intended for use there. If you use it from elsewhere, you understand that your information will be transferred to, stored and processed in the United States, where data protection laws may differ from those of your country.
General Terms
This policy is a statement of our practices; it does not create a contract or any right in any third party. To the fullest extent permitted by law, Land & Sea and its agents, employees and service providers are not liable for any loss or damage arising from unauthorized access to or use of information that was beyond our reasonable control, or from the acts or omissions of third parties. Nothing in this policy limits any right you have that cannot be limited by law. If any provision is found unenforceable, the remaining provisions remain in full effect. Except where federal law governs, this policy and any dispute about it are governed by the laws of the State of Florida, and the state and federal courts serving Collier County, Florida have exclusive jurisdiction over any such dispute, to which you consent.
Changes to This Policy
We may update this policy from time to time. The updated version takes effect when it is posted on this page with a new effective date. If we make a material change to how we use personal information we have already collected, we will give notice on the Site or by other reasonable means. Your continued use of the Site after a change is posted means you accept it.
