DMCA and Copyright Policy
Effective November 1, 2026
Ultra Realty Group LLC, doing business as Land & Sea International Realty (“Land & Sea,” “we,” “us”), respects the intellectual property rights of others and expects the same of everyone who uses landandsearealty.com and any related pages, listings, feeds and media we operate (the “Site”). This policy explains how to report material on the Site that you believe infringes your copyright, how a person whose material was removed may respond, and how we handle those reports under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”).

How to File a Notice of Claimed Infringement
To be effective under 17 U.S.C. § 512(c)(3), a notice must be in writing and must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it, including the full URL of each page on which it appears and, for an image, the image’s own URL.
- Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Please also include the registration number of the work with the U.S. Copyright Office, if one exists, and evidence of your ownership or authority. A notice that does not substantially comply with all six requirements is not effective notice under 17 U.S.C. § 512(c)(3)(B), does not establish knowledge or awareness on our part, and will not be acted on as a DMCA notice. Where a notice substantially meets requirements 2, 3 and 4 only, we may contact the sender to ask for the missing information.
What Happens After a Valid Notice
On receipt of a notice that complies with this policy, we will act expeditiously to remove or disable access to the material identified. Where the material was supplied by a third party, we will take reasonable steps to notify that party and provide a copy of the notice. Removal or disabling of access is not an admission of liability, infringement or the validity of any claim, and we reserve every right, defense and remedy available to us, including fair use, license, implied license, the absence of copyright protection and any limitation of liability provided by law.
We may, in our discretion, remove or disable access to material that is the subject of a report even where the report is incomplete. We are not obliged to do so, and doing so does not waive the requirements of this policy for any other report.
Counter-Notification
If material you supplied was removed or disabled and you believe this resulted from mistake or misidentification, you may send a counter-notification to our designated agent. To be effective under 17 U.S.C. § 512(g)(3), it must be in writing and include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, any judicial district in which Land & Sea may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.
On receipt of a valid counter-notification, we will forward a copy to the person who sent the original notice and inform that person that we will replace the removed material or cease disabling access to it in 10 business days. We will restore the material no less than 10 and no more than 14 business days after receipt of the counter-notification unless our designated agent first receives notice that the complaining party has filed an action seeking a court order to restrain the alleged infringement. We are not obliged to restore material that we have separately decided, in our discretion, not to publish.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, is liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner or its licensee, or by Land & Sea as a result of our reliance on that misrepresentation. Notices are made under penalty of perjury. Before sending a notice, consider whether the use may be authorized, licensed or a fair use under 17 U.S.C. § 107; if you are unsure, consult an attorney. We reserve the right to seek all available remedies against anyone who submits a notice in bad faith, and to decline to act on notices from any sender who has previously submitted false, abusive or automated demands.
Repeat Infringers
In appropriate circumstances, and at our sole discretion, we will terminate the access, accounts, content contributions or other privileges of any user or contributor who is a repeat infringer, consistent with 17 U.S.C. § 512(i). We may also restrict or remove access for anyone whom we believe, in good faith, infringes the rights of others, whether or not that person is a repeat infringer.
Listing Content and Third-Party Material
Property listings, listing photographs and related data shown on the Site are supplied through an Internet Data Exchange (IDX) feed from the Naples Area Board of Realtors® multiple listing service under that service’s rules, and remain the property of the listing brokerages, their photographers or the MLS. Land & Sea does not select, edit or store that content and has no control over it. If you believe a listing photograph or description infringes your copyright, send a notice to our designated agent as described above, and we will act on it as it applies to the Site and, where appropriate, refer it to the listing brokerage and the MLS. The Site may also link to or embed material hosted by others, including maps, videos and third-party websites; claims about that material should also be directed to its host.
Our Own Content
Except for listing content and material credited to others, the text, design, photography, graphics, market analysis and other content of the Site are owned or licensed by Land & Sea and are protected by United States and international copyright, trademark and other laws. No part of the Site may be reproduced, republished, scraped, framed or used to train any software or artificial intelligence model without our prior written permission, except as permitted by law. Requests for permission may be sent to [email protected].
Before You Send a Demand
If you own a work that appears on the Site, we want to hear from you directly. Most concerns can be resolved quickly by writing to our designated agent with the information listed above. We will review every complete notice promptly and in good faith. Demands for payment, settlement offers or threats of litigation sent in place of a DMCA notice will not delay or replace the process in this policy, and their receipt does not constitute notice of infringement.
General Terms
This policy is provided for information only and is not legal advice. Nothing in it creates any obligation beyond those imposed by the DMCA, waives any right, defense, privilege or limitation of liability available to Land & Sea, or constitutes an admission of any kind. Our failure to enforce any part of this policy is not a waiver of it. If any provision is found unenforceable, the remaining provisions remain in full effect. We may revise this policy at any time by posting a new version on this page, effective on posting. Except where federal law governs, this policy is governed by the laws of the State of Florida.
